1. Acceptance of these terms

These Terms of Service (“Terms”) are a legal agreement between you and Pinglist (“Pinglist,” “we,” “us”) governing your use of the Pinglist mobile app, website, and related services (the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

2. What Pinglist does

Pinglist lets you create “watches” for publicly available listings, prices, pages, and releases, and sends you notifications when it detects a change. The Service checks sources on a best-effort, automated basis.

• We do not guarantee that alerts are complete, accurate, or delivered within any specific time. Detection depends on third-party sources we don’t control.
• Always verify the current price, availability, and details on the original source before making a purchase or other decision. You act on alerts at your own discretion and risk.
• Pinglist is an independent service and is not affiliated with, endorsed by, or sponsored by any of the sources it can monitor. All product names, logos, and brands are the property of their respective owners.

3. Your account

You can use Pinglist through an anonymous, device-based account, or sign in with Apple or Google. You’re responsible for activity that happens under your account and for keeping your sign-in method secure. You must be at least 13 years old (or the minimum age required in your region) to use the Service.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Use the Service to violate the terms, robots rules, or rights of any third-party website or source, or to monitor content you’re not permitted to access.
• Attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its infrastructure.
• Resell, sublicense, or commercially exploit the Service without our written permission.
• Use the Service to harass, harm, or infringe the rights of others.

We may suspend or terminate accounts that misuse the Service.

5. Subscriptions, billing, and renewals

Pinglist offers an optional paid plan (“Pinglist Pro”). Paid subscriptions are sold and billed through the Apple App Store or Google Play and managed via our payments partner, RevenueCat.

• Subscriptions auto-renew for the same period and price until canceled. Your account is charged through your app store at confirmation of purchase and at each renewal.
• You can manage or cancel your subscription anytime in your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period.
• Payments, refunds, and free-trial terms are subject to the policies of the app store that processed your purchase. We generally cannot issue store refunds directly.
• If a paid feature changes or is discontinued, we’ll act reasonably and in line with these Terms and the applicable store rules.

6. Intellectual property

The Service — including its software, design, and content we provide — is owned by Pinglist and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the Service under these Terms. You retain ownership of the watches and content you create; you grant us the limited rights needed to operate the Service for you (for example, to check your watches and send your alerts).

7. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, timely, or that any alert will be delivered. Information surfaced from third-party sources is not verified by us.

8. Limitation of liability

To the maximum extent permitted by law, Pinglist and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, missed opportunities, or purchases made or missed in reliance on the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or US $50. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.

9. Indemnification

You agree to indemnify and hold Pinglist harmless from claims, losses, and expenses arising out of your misuse of the Service or your violation of these Terms or applicable law.

10. Termination

You can stop using the Service at any time and delete your account from Settings → Delete account in the app. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (such as disclaimers and limitation of liability) will continue to apply.

11. Changes to the Service and these Terms

We may update, change, or discontinue parts of the Service, and we may revise these Terms from time to time. When changes are material, we’ll update the “Last updated” date and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Pinglist is operated, without regard to conflict-of-law principles, and you agree to the exclusive jurisdiction of its courts for any dispute, except where applicable law gives you the right to bring a claim elsewhere.
